DIGITAL IMAGE LICENSE AGREEMENT

By purchasing and/or downloading any digital image from this website, you (“Licensee”) agree to the following terms and conditions. This agreement constitutes a legally binding contract between the Licensee and Craig VanHyning (“Licensor”).

All images are licensed, not sold. Copyright remains exclusively with the Licensor.

1. OWNERSHIP

All images are protected by United States and international copyright law. No ownership rights are transferred under this agreement. The Licensee receives only the specific usage rights defined below.

2. LICENSE TYPES

The rights granted depend on the license type selected at purchase.

A. Personal Use License

Permitted Uses:

  • Personal display in home or private space

  • Printing for personal display

  • Personal device use (desktop, phone, tablet)

  • Posting to personal social media accounts with visible credit to the Licensor

Prohibited Uses:

  • Commercial or business use of any kind

  • Advertising or promotional use

  • Use by any company, brand, organization, or business entity

  • Resale, redistribution, sublicensing, or file sharing

  • Uploading to stock platforms

  • Use in print-on-demand services

  • Use in NFTs, blockchain, or AI training systems

  • Alteration beyond minor cropping

This license is non-transferable and non-exclusive.

B. Editorial License

Permitted Uses:

  • One-time publication in a specified editorial context (print or digital)

  • Use within a single issue, article, or feature

  • Online archival use directly connected to that publication

Requirements:

  • Visible credit to Craig VanHyning

  • No commercial advertising use

  • No use beyond the agreed publication

Any reuse requires a separate license.

C. Commercial License

Commercial licenses are limited to the scope defined at purchase, including:

  • Specific medium (web, print, advertising, etc.)

  • Specific duration

  • Specific geographic territory

The image may not be resold, sublicensed, or used outside the agreed scope.

Expanded usage requires additional licensing fees and written approval.

3. RESTRICTIONS APPLICABLE TO ALL LICENSE TYPES

The Licensee may not:

  • Claim authorship of the image

  • Remove embedded metadata or copyright notices

  • Register the image for copyright

  • Use the image in defamatory, unlawful, or immoral contexts

  • Transfer this license to another party

4. TERMINATION

Violation of any term results in automatic termination of the license. Upon termination, the Licensee must cease use immediately and delete all copies of the image.

The Licensor reserves the right to pursue damages and legal remedies for unauthorized use.

5. LIMITATION OF LIABILITY

The Licensor shall not be liable for any indirect, incidental, or consequential damages arising from use of the image.

6. GOVERNING LAW

This agreement is governed by the laws of the United States and the State of Arizona.

By selecting “I Agree to the License Terms” and completing the purchase, the Licensee acknowledges that they have read, understood, and agreed to all terms of this agreement.
